CÓDIGO PENAL BRASILEIRO - Prestação de serviços à comunidade ou a entidades públicas

Art. 46. A prestação de serviços à comunidade ou a entidades públicas é aplicável às condenações superiores a seis meses de privação da liberdade.
§ 1o A prestação de serviços à comunidade ou a entidades públicas consiste na atribuição de tarefas gratuitas ao condenado.
§ 2o A prestação de serviço à comunidade dar-se-á em entidades assistenciais, hospitais, escolas, orfanatos e outros estabelecimentos congêneres, em programas comunitários ou estatais.
§ 3o As tarefas a que se refere o § 1o serão atribuídas conforme as aptidões do condenado, devendo ser cumpridas à razão de uma hora de tarefa por dia de condenação, fixadas de modo a não prejudicar a jornada normal de trabalho.
§ 4o Se a pena substituída for superior a um ano, é facultado ao condenado cumprir a pena substitutiva em menor tempo (art. 55), nunca inferior à metade da pena privativa de liberdade fixada.

(BRAZILIAN PENAL CODE - Provision of services to the community or public entities

Art. 46. The provision of services to the community or to public entities shall apply to convictions for more than six months of deprivation of liberty.
Paragraph 1. The rendering of services to the community or to public entities consists in the attribution of gratuitous tasks to the condemned person.
Paragraph 2. The provision of service to the community shall be provided in charitable organizations, hospitals, schools, orphanages and other similar establishments, in community or state programs.
Paragraph 3. The tasks referred to in paragraph 1 shall be assigned according to the abilities of the convicted person and must be fulfilled at the rate of one hour of duty per day of conviction, fixed in such a way as not to prejudice the normal working day.
Paragraph 4. If the substituted sentence exceeds one year, the sentenced person may serve the substitute sentence in a shorter time (article 55), which shall not be less than half the custodial sentence fixed.)
